The 4 Issues With the WH&S Act 2011 for Building Managers


There has been a great deal of concern in the body corporate sector about the effects of the new Work Health & Safety Act 2011 (WH&S) since it came into force on 1January 2012. This is in part due to the headline-catching potential fines and obligations, and in part due to the confusion about what is actually required in order to comply with the Act.

One thing is clear; there is more responsibility than ever on on-site managers to fulfil their obligations in relation to the health and safety of workers, occupiers and visitors to the buildings.

However, considering the legislation as a whole, it can actually be used to ensure that the best (and safest) practice is put into place.

The 4 main issues for on-site managers arising from the WH&S Act are:

  1. Ensuring the on-site operations, and their associated hazards and risks, are understood by the Officers of the Person Conducting Business or Undertaking (PCBU).
  2. The requirement for policies and procedures to be put in place to help the PCBU fulfil its duties (whether the PCBU is the body corporate or the on-site manager themselves).
  3. The need to implement those policies and procedures.
  4. Helping the Officers of the PCBU (whether committee members or the on-site manager) to keep current information on WH&S matters.

The Solution

To help on-site managers deal with the first three issues, Star BMS have devised a new maintenance schedule and log book package. The package helps reduce the risk to health and safety of everyone on site in relation to the on site operations and at the same time ensures that the property is appropriately maintained.

Through their combined maintenance schedule and log book, the on-site manager will have at hand:

  • A clear, graphical representation of when regular maintenance of common parts, plant and machinery is to be undertaken.
  • A record of contractor’s insurance and (where appropriate) their licenses.
  • A full and detailed record of legislative safety requirements for the property.
  • A clear understanding of what regular maintenance is required on site.
  • A means for recording contractor’s site visits to attend to each of the above matters, with a check list for each element.

This package is available ‘made-to-measure’ and can cater for all body corporate requirements, from simple occupier statement records for smaller sites to a full report for all maintenance at large properties.

The fourth issue can be dealt with by way of regular Work Health & Safety inspections.
